Negotiating a 1031 Exchange and Defer Capital Gains Tax

Many commercial property investors believe that the sole purpose of the 1031 Exchange is to avoid paying taxes on their capital gains. However the 1031 exchange is a versatile tool for commercial real estate investors.

We see many people with a Multi-Family Investment and after a few years they want to increase their position in the Florida market. So they can notify us to search for a larger and more expensive Apartment Building Investment. The strategy when acted out following the 1031 Rules will allow the investor to trade into a larger property. The Owner is also the seller of their Apartment Building. Let’s say they bought it for $5,000,000 and sell it for $8,500,000. The capital gains taxes would be on the $3,500,000 profit. However the 1031 Exchange allows the Investor to defer paying the capital gains on that profit.

One 1031 rule of thumb to remember is you must file a list of possible replacement commercial properties with an intermediary within 45 days of closing on your initial property.
